Terms of Use

These Terms govern your use of the Kakii app and related services provided by Kakii Technologies Pte Ltd.

Agreement and eligibility

By creating an account, including a guest account, or using Kakii, you agree to these Terms and our Privacy Policy. You must be at least 16 years old and legally permitted to use the service in your country. If you do not agree, do not use Kakii.

Run safely and use your own judgment

Kakii is a game layered over real running on real streets. You are responsible for choosing whether, where, and how to run. Watch traffic, obey local laws, respect private property, assess weather and terrain, and stay within your physical limits. Never follow the app when doing so would be unsafe. Kakii does not inspect or guarantee that a user-created track is safe, legal, open, accurate, or suitable for you. Consult a qualified medical professional before beginning an exercise programme if you have health concerns.

Your account

• You are responsible for activity under your account and for keeping sign-in credentials secure.
• A guest account has no recoverable sign-in credential. Signing out or losing the device may permanently remove your access to it.
• Use one account per runner and provide accurate bracket information.
• You may delete your account from Kakii Settings.

Community content

You retain ownership of tracks, names, tips, reviews, and other content you create. By publishing content, you grant Kakii a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt for display, moderate, and show it as needed to operate and promote Kakii. Do not publish illegal, unsafe, deceptive, abusive, discriminatory, infringing, or privacy-invasive content. Do not publish a route that encourages trespass or dangerous conduct.

Users can report content and block other runners. We may review, hide, remove, or preserve content; restrict features; or suspend or terminate accounts to protect users, enforce these Terms, comply with law, or maintain fair competition.

Fair play

Do not submit runs recorded in a vehicle, spoof GPS or motion data, manipulate timing, automate participation, exploit the service, or interfere with other runners. Kakii may invalidate suspicious runs, remove results or rewards, and restrict accounts. Automated validation is an aid and may occasionally be wrong.

Kakii Club

Kakii Club is an optional auto-renewing subscription purchased through Apple. The subscription name, period, benefits, and current price are shown before purchase. Payment is charged to your Apple Account and the subscription renews unless cancelled through Apple's subscription settings. Deleting Kakii or your Kakii account does not cancel billing. Refunds and billing disputes are handled under Apple's policies and applicable law. Kakii may change Club benefits prospectively while continuing to provide ongoing value during an active paid period.

Apple terms

If you obtain Kakii through the App Store, Apple's Standard Licensed Application End User License Agreement also applies. If these Terms conflict with mandatory terms Apple requires for the licensed app, Apple's required terms control to that extent.

Service availability and changes

Kakii may change, pause, or discontinue features, events, leaderboards, seasons, rewards, or the service. We do not promise that every feature or user-created track will always remain available. We may update these Terms and will provide notice when appropriate.

Third-party services

Kakii relies on services provided by Apple and other technology providers. Their own terms may apply. Kakii is not responsible for third-party services outside our control.

Disclaimers

To the maximum extent permitted by law, Kakii is provided “as is” and “as available.” Kakii Technologies Pte Ltd disclaims implied warranties including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability. Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Kakii Technologies Pte Ltd will not be liable for indirect, incidental, special, consequential, or punitive loss, lost profits, lost data, or injury arising from unsafe running choices or user-created routes. Our aggregate liability relating to Kakii will not exceed the amount you paid for Kakii during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited.

Governing law

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. The courts of Singapore have exclusive jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere.
